ApneaCam – Terms of Use (Clinical Use)

1. Intended Use
ApneaCam is a clinical decision support tool intended for screening purposes only.
It:
- is not a diagnostic device
- does not replace clinical judgment
- cannot confirm or exclude sleep apnea
2. Use Involving Minors
Clinical use involving minors must comply with all applicable laws, institutional requirements, and parental or legal guardian consent obligations. The clinician or institution is solely responsible for obtaining all required authorizations before image capture.
3. Professional Responsibility
Healthcare professionals are solely responsible for:
- interpreting results
- making clinical decisions
- determining patient management and referrals
4. Patient Consent
Users must ensure that appropriate patient consent is obtained prior to image capture and use of ApneaCam.
5. Facial Attribute and Morphological Feature Estimation
As part of the screening process, ApneaCam may estimate certain image-derived attributes and anatomical features relevant to sleep-apnea risk assessment, including approximate age, biological sex, body mass index, and craniofacial or airway-related morphological characteristics. These estimates are intended solely to support sleep-health screening, research, validation, and product development. They are not intended to establish identity, verify age, determine eligibility, or support decisions unrelated to sleep health.
6. No Identity Verification
ApneaCam is not intended for identity verification, age verification, facial recognition, surveillance, biometric identification, or any law-enforcement or security-related purpose.
7. Permitted Use
You agree to:
- use ApneaCam in accordance with professional standards
- not misuse or attempt to reverse engineer the system
8. Device Independence
ApneaCam operates independently of any third-party hardware manufacturer, camera-enabled device, operating system, or software platform used for image capture. References to smartphones, tablets, cameras, or other devices are descriptive only and do not imply endorsement, sponsorship, certification, or affiliation with Consusis Inc.
9. Limitation of Liability
ApneaCam is provided “as is” without warranties of any kind, whether express or implied.
ApneaCam is provided as a clinical decision-support and screening aid for research and validation purposes only and does not replace clinical judgment, professional medical evaluation, or formal diagnostic testing.
To the maximum extent permitted by applicable law, Consusis Inc., its officers, directors, employees, advisors, affiliates, and research collaborators shall not be liable for any direct, indirect, incidental, consequential, special, or reliance-based damages arising from or related to:
- use of ApneaCam
- interpretation or reliance upon screening outputs
- clinical decisions made by users
- inaccuracies or limitations in screening estimates
- diagnostic or treatment outcomes
- interruption, unavailability, or technical malfunction of the platform
10. Research Use
ApneaCam may be used in clinical validation and research settings where permitted and appropriately approved.
11. Modifications
We may update these Terms at any time.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
