ApneaCam – Privacy Policy (Consumer Use)

ApneaCam is provided by Consusis Inc. (“we,” “us,” or “our”). This Privacy Policy explains how information is processed when you use ApneaCam.
1. Information We Process
When you use ApneaCam, we may process:
- Facial and oral images (frontal, profile, open mouth)
- User-provided inputs (e.g., snoring, daytime sleepiness, high blood pressure)
- Optional demographic information (e.g., race/ethnicity)
- Technical information (e.g., device type, session-related data)
- Image-derived attributes, anatomical measurements and morphological features
- Screening estimates, risk scores and associated results
- Research-related data, where applicable
We do not request or require directly identifying information such as name or address to use the screening tool.
2. How Information Is Used
Information is processed to:
- Generate sleep apnea screening estimates
- Maintain functionality and reliability of the application
- Support research, validation, performance evaluation, calibration, and product development, only where applicable permissions and legal requirements for those purposes have been satisfied.
Processing is performed using automated systems, including artificial intelligence models.
3. Research and Development
Consusis may use submitted images, associated information and screening results for research, validation, performance evaluation, calibration and development of sleep apnea screening technologies, subject to the applicable permissions, lawful basis and legal requirements.
Optional research participation, where offered, is subject to the user’s separate research consent. Research use may include self-reported racial or ethnic origin, if provided, for population-level performance evaluation, model calibration and assessment of potential bias.
For research activities involving clinical patients, the applicable patient information, agreement or consent requirements must be satisfied. Specific research studies may require additional consent, approvals or agreements.
Research data may be de-identified or pseudonymized where appropriate. De-identification does not necessarily mean that information is anonymous or can no longer be associated with an individual.
4. Access to Information
Access to information is limited to authorized personnel, contractors, and collaborators who require access to support platform operation, research, validation activities, security, or product development and who are subject to appropriate confidentiality obligations.
Access to or sharing of information with research collaborators is limited to activities for which the applicable permissions, lawful basis and contractual or other required arrangements are in place.
5. Data Storage and Security
- Data is processed using secure cloud infrastructure
- Reasonable technical and organizational safeguards are applied
- No method of transmission or storage is completely secure
6. Third-Party Processing
Consusis may use trusted third-party service providers and cloud infrastructure providers to support storage, processing, analytics, and operation of the platform.
Third-party service providers process information on behalf of Consusis where acting in that capacity, under applicable contractual and security requirements. Other recipients, where applicable, may process information in accordance with their respective roles and the applicable privacy disclosures.
7. Data Retention
Information (screening images and session information, screening results and associated records, research and validation datasets) is retained only for as long as reasonably necessary to support system operation, research, validation, regulatory, product improvement, and compliance with applicable legal obligations. De-identified information may be retained for longer periods for scientific, analytical, and algorithm development purposes.
8. Your Rights
You may request deletion of your submitted data, subject to technical feasibility and applicable legal requirements.
Where applicable under relevant data-protection laws, you may have additional rights regarding your personal data, including rights to restrict or object to certain processing, withdraw consent, or request data portability. The availability and scope of these rights depend on applicable law and the circumstances of the processing.
If you are a Virginia resident, you may have rights under applicable law, including the right to access, correct, or delete personal data and to opt out of certain data processing activities, subject to legal limitations.
